1. Purpose and acceptance

These general terms of use (hereinafter: "Terms") govern access to and use of the website of Centre Chirurgical de Champel SA (hereinafter: "the Clinic"). The purpose of the website is to present the Clinic's activities and services and to provide an interface for submitting applications for job offers. By accessing and browsing the website, the user accepts these Terms without reservation. Users who do not accept them are asked not to use the website.

2. Website access and availability

Access to the website is free of charge. The Clinic strives to keep the website available at all times but does not guarantee its permanent accessibility or the absence of errors or malfunctions. It cannot be held liable for interruptions due to maintenance operations, technical failures or causes beyond its control. The Clinic reserves the right to modify, suspend or discontinue all or part of the website at any time and without notice.

3. Medical information — no medical advice

The information published on the website is provided for general information purposes only. Under no circumstances does it constitute medical advice, a diagnosis, a consultation or a treatment recommendation, and it cannot replace a consultation with a qualified healthcare professional. Any decision regarding treatment must be made with a physician, based on an individual assessment.

In a life-threatening emergency, call 144 (emergency medical dispatch centre). The website and its forms are not intended for handling emergency situations.

4. Getting in touch

Requests submitted via the contact form, by e-mail or by phone do not create any therapeutic relationship between the user and the Clinic. Users are asked not to send detailed medical information (diagnoses, test results, medical documents) via the contact form or by unsecured e-mail; such information is collected within the secure framework of care.

5. Job applications

Users submitting an application warrant the accuracy and sincerity of the information and documents provided. The data submitted is treated confidentially, solely for recruitment purposes, in accordance with the website's privacy policy. Applicants may request the deletion of their file at any time by writing to info@cliniquechampel.ch.

6. Intellectual property

All website content (texts, images, photographs, illustrations, logos, graphics, structure, layout) is the exclusive property of the Clinic or is used under licence. Any reproduction, representation, modification, distribution or exploitation, in whole or in part, without the Clinic's prior written authorisation is prohibited, subject to mandatory legal exceptions.

The Clinic makes every effort to ensure the accuracy and currency of the information published, without however being able to guarantee it. Privacy policy

1. Data controller

The controller of the personal data collected via this website is Centre Chirurgical de Champel SA, Avenue de Champel 40 bis, 1206 Geneva, Switzerland (hereinafter: "the Clinic" or "we"). Contact: info@cliniquechampel.ch.

This policy covers exclusively processing related to the website. The processing of patient data in the context of care is the subject of separate information provided upon admission.

2. Data processed

• Contact requests (form, e-mail, phone): identity, contact details, message content.
• Job applications: identity, contact details, curriculum vitae, cover letter, diplomas and certificates and, where applicable, practice licences.
• Technical data: IP address, connection data and cookies (see the cookie policy).

Important: please do not send detailed medical information via the contact form or by unsecured e-mail. Such information is collected within the secure framework of consultation and admission.

3. Purposes and legal bases

We process your data in accordance with the principles of the FADP (art. 6), for the following purposes:

• responding to your requests and getting back to you (pre-contractual measures, overriding interest in handling requests);
• managing applications and conducting the recruitment process (pre-contractual measures; art. 328b of the Swiss Code of Obligations);
• ensuring the operation, security and improvement of the website (overriding interest; consent for audience measurement cookies);
• complying with our legal obligations.

4. Data recipients

Your data is accessible only to authorised Clinic staff who need it to handle your request. It may be disclosed to technical service providers acting on our behalf as processors within the meaning of art. 9 FADP (website host; WAP Sàrl for development and maintenance), contractually bound to data confidentiality and security. It may also be disclosed to authorities where required by law. We do not sell or rent your data to third parties.

5. Disclosure abroad

The website is hosted in the European Union (France, OVH). In connection with the use of Google Analytics 4, some data may be transferred to the United States to Google LLC, a company certified under the Swiss-U.S. Data Privacy Framework, recognised by the Federal Council as providing an adequate level of protection (art. 16 FADP).

6. Retention periods

• Contact requests: for the time needed to handle the request, then deleted no later than 24 months.
• Job applications: for the duration of the recruitment process, then destroyed within 6 months of its closure, unless the applicant agrees to retention for future positions (24 months at most).
• Technical data and connection logs: 12 months at most.

Longer retention periods required by law remain reserved.

7. Data security

We implement appropriate technical and organisational measures within the meaning of art. 8 FADP to protect your data against unauthorised processing, loss or disclosure (access control, encryption of communications, backups, staff awareness).

8. Your rights

In accordance with art. 25 ff. FADP, you have the following rights: right of access to your data, right to rectification, right to erasure, right to object to processing, right to obtain the delivery or transfer of certain data (art. 28 FADP) and right to withdraw consent. To exercise your rights, send your request in writing to info@cliniquechampel.ch or by post to the Clinic's address, together with proof of identity. We generally respond within 30 days. You may also contact the Federal Data Protection and Information Commissioner (FDPIC).
